As it does in many other states, SR22 insurance gets Utah drivers into the legal mainstream. Under Utah’s Financial Responsibility Act all drivers must present their proof of insurance to peace officers on demand. The state’s Department of Motor Vehicles also runs periodic computer checks comparing its list of registered vehicles with a database of auto insurance policies issued to Utah residents.
Utah law mandates that you carry accidental bodily injury and accidental death coverage, as well as personal property liability coverage, on all the vehicles you operate. Minimum coverage amounts are:
$25,000 in bodily injury per accident$50,000 in death liability per accident$15,000 in personal property liability per accident. Personal property coverage includes damage other vehicles or structures, trees, fences and signs.
Utah drivers caught without auto insurance need to file SR22 forms. When a traffic stop or the DMV computer check reveals that you don’t have minimum auto insurance coverage, The DMV will send you a notice asking for proof of insurance. If an administrative hearing with the state’s Department of Public Safety rules that you’re driving uninsured, the DPS will suspend your driver’s license.
To have it reinstated, you must purchase insurance from a Utah-licensed insurance provider within 30 days and file an SR-22 insurance form with the DPS. After receiving your SR-22 filing and your $100 reinstatement fee, the DPS instructs the DMV to restore your driving privileges.
You’ll need to file the SR-22 form whether the vehicles you drive are yours or belong to someone else.
Once you’ve been convicted of driving without insurance, you must supply the DPS with proof of coverage for three consecutive years. If your coverage lapses for any reason during this period, the law requires that you surrender your driver’s license to the DMV. You must purchase insurance and refile an SR22 form with the DPS before applying for a new license.
Penalties for Utah drivers convicted of driving under the influence of vary depending ages. As of July 2011, if you’re younger than 19 and convicted of a DUI, the penalties you face include:
