Involved in DUI, would dui auto insurance rates be higher?

Ron artest: I was involved in dui, would dui auto insurance rates be higher?  How high? Any hints…

Response : Ron, yes, dui auto insurance rates would be higher.

A conviction for DUI, or driving under the influence of drugs or alcohol, is a very serious offense, even if it your first conviction. In general, DUI will cost you thousands of dollars in the long run, and may jeopardize your ability to drive your car over a period of time.

In most states, drivers agree to submit to DUI testing voluntarily when they receive their driver’s licenses. As a driver’s license is a privilege, and not a right, states have the power to demand that drivers who apply for a license agree to these terms. If your state has a law in place that requires you to submit to DUI testing, you must do so if you are pulled over or face losing your license altogether.

When you are tested for DUI, a blood alcohol content, or BAC, reading will be taken by testing your breath, your blood, or both. If your BAC is over the legal limit, you will be charged with DUI. You may have to hire a lawyer to represent you in court; if you plead guilty, you will face several consequences.

Most states have a stiff fine and penalty system for punishing DUI offenders. On average, it will cost you several hundred dollars just for the DUI fine for a first offense, and many states also require you to attend, and pay for, driver education courses dealing with alcohol and motor vehicles. You may also have to pay reinstatement fees to recover your license, as well as court fees.

Insurance cost of dui insurance

The real cost, however, is not just in immediate fines and fees. Over time, your insurance rates will probably skyrocket when your insurance company learns of your DUI. This happens because insurance companies usually scan the public records just before issuing renewal notices. If the company happens upon your DUI record, you can expect a fee increase or outright cancellation. Many companies simply will not insure someone who has a DUI conviction, so you may be forced to search for other automobile insurance.

Assuming that your company keeps your policy in force, you can count on higher premiums. While the cost will vary from individual to individual and company to company, you can expect a minimum of a 20% increase in your premiums, and many people see an increase of 40%. This means that if you were paying $1000 per year prior to your DUI, you can expect to pay $1200 to $1400 per year afterwards. This rate increase will stay in effect as long as the DUI is on your record.

In some states, DUIs stay active in your file for three years; in others, the DUI stays in your record permanently. The rate you are charged also depends on the rest of your driving record; a speeding ticket six months before your DUI can have a great impact on your new rate, and an accident can send your prices soaring.

DUI auto insurance rates comes with SR22 requirement

Some states also require the filing of a document called an SR-22 after a DUI conviction. An SR-22 is a paper which your insurance company provides which states that you are insured for a certain period of time. Many major companies will not issue SR-22’s; if this is the case, you will have to seek other insurance.

Some companies that specialize in SR-22 insurance are The General and Progressive. However, some companies such as State Farm may require you to move your insurance to a different division of the company which carries high-risk policies. No matter how your SR-22 insurance is handled, one sure bet is that it will cost you more money than someone without this requirement.

Imparied driving and DUI car insurance

DUI Car insurance

Rachel  : How are impaired driving offences determined? How is it important to dui car insurance?

Response : First let me answer your second question related to dui car insurance. Impaired driving is driving under influence or drunk driving. When one is under the influence of alcohol, it affects your brain and your sense of judgment and stability. Hence persons under intoxication are prone to impaired driving. They are more likely to be involved in accidents and these persons are considered as high risk. The insurance companies charge high rates for dui car insurance and the person charged with this offence would need SR22 car insurance.

Now coming to the how driving offences are decided it would depend upon the state laws. However the general rules and guidelines are as given below:

 Each State should enact impaired driving laws that are sound, rigorous, and easy to enforce and administer. Treating both offenses similarly;

The laws should clearly define offenses, contain provisions that facilitate effective enforcement, and establish effective  consequences. The laws should define offenses to include

 1) Driving while impaired by alcohol or other drugs (whether illegal, prescription or over-the-counter) and to operate a vehicle at or above this level without having to prove impairment;2) Driving with a blood alcohol concentration (BAC) limit of .08 grams per deciliter, making it illegal “per se” driving offense;

3) Driving with a high BAC (i.e., .15 BAC or greater) with enhanced sanctions above the standard impaired their system

4 )  Zero Tolerance for underage drivers, making it illegal “per se” for people under age 21 to drive with any(i.e., .02 BAC or greater);

  5) Repeat offender with increasing sanctions for each subsequent offense; 6) BAC test refusal with sanctions at least as strict or stricter than a high BAC offense;

6) Personal injury while driving impaired as separate offenses with additional sanctions;

 7) Driving with a license suspended or revoked for impaired driving, with vehicular homicide or causing

These are some of the broad applicable laws for impaired driving. It is best not to drive when you are impaired. Your auto insurance rates for DUI SR22 car insurance will increase a lot once you are arrested for this offence.  However, you would still get good SR22 car insurance if you follow some strategies.

Thanks.

Michael Vint : What happens to my car insurance, if I am involved in a DUI?

Response : Unfortunately, one of the penalty of being arrested and charged for a DUI is that your auto insurance may boost. There’s also the possibility that your policy will be canceled. Auto insurance companies will now perceive you to be a risky driver. It can be enormously frustrating to shop for car insurance when it has increased by several hundred dollars.

Here are a few things you will have to keep in mind:

You’ll need to file an SR-22. This is a document that you will need to provide to the local DMV in order to change your suspension status and get your driver’s license reinstated. Check with your DUI lawyer to see if he/she can recommend any insurance companies that will help file your SR-22. There are a few insurance companies that will cover you, so shop around and be

Expect to pay higher premiums and down payments. While a driver with a clean driving record may pay under 100 dollars a month, another driver with a DUI can find that his/her rates increased to 200 per month or more.

The best way to avoid all this hassle with car insurance is, of course, to not drink and drive at all. The consequences of DUI can be costly, but if you learned your lesson and maintain a good driving record, you won’t have to go through this again.

Enlist yourself in an alcohol treatment or DUI program as soon as feasible after your DUI conviction. This will exhibit to the auto insurance company that you are serious about not making the same mistake again, and that you take the problem gravely and  uncomplaining.

Add the ignition lock on your steering wheel so that you will never commit the same mistake.

The best thing to do for insurance is to shop online for cheap SR22 insurance rates, since some speciality class insurers offer you cheap sr22 car insurance.

DUI Car insurance

What are the consequences of major and minor tickets?

Response : A driver knows the consequences of breaking the rules of the road – one is given a tickets for breaking the rules.The minor offences are :

  • Making an improper turn;
  • Breaking the stop sign rule;
  • Wrong parking ;
  • Driving without a seat belt.

These are considered minor offences and the demerit points given are usually 2 points. However, this will differ upon the state and the circumstances prevailing – whether you get involved in an accident due to this violation.

The major offences are :

  • Speeding is considered a major offence. The speed limit should be strictly maintained. Normally if you are driving over the speed limit of 16-29 an hour – 3 demerit points are applied on your driving license. If you are driving at the speed of 0ver 29-50 per hour than the demerit points are 6.Depending upon the severity your driving license can be revoked and the insurance company can cancel your policy.
  • Driving under influence. This is a major offence. The penalty for this is either suspension of your driving license, you are charged and the state rules differ but most states require that you should have a SR22 form for 3 years from an insurance company.

 Normally the rates of insurance do not increase heavily for minor offences but major offences are considered high risk auto insurance risk and the auto insurance premium would increase.
