“This will impose the toughest sanction in the land, and we hope, change behaviour,” Solicitor-General Mike de Jong told The Province.
Refusing to give a breathalyzer sample at the roadside is no longer a way out, he said.
Officers can now impose roadside bans of more than 24 hours on drivers, without having to take them back to the station.

South Carolina: Cheap sr22 insurance ?

The driver of the car, a 20-year-old woman from Central, was driving with two passengers.
Frazier gave her a field sobriety test, a process that takes about 10 minutes.
She failed.
He took her into custody and drove her to the South Carolina Law Enforcement Division’s Mobile Blood Alcohol Testing unit, or BatMobile, that was parked nearby. After informing the woman of the process of having her blood alcohol tested and providing her with a copy of the rules and regulations and her rights, Frazier sat in a small compartment inside the BatMobile, waiting for a 20-minute period to elapse.
“We have to give the suspect 20 minutes so that any residual alcohol in their mouth will dissipate,” he said. “It is one of many technicalities we have to be careful about.”
Meanwhile, the suspect sat in the larger compartment, locked in and unable to communicate with anyone other than Frazier, who sat about two feet away on the other side of a shatterproof plastic window.
When the 20 minutes had elapsed, the girl blew into the BAT testing machine.
Her blood-alcohol-content came back several points above the legal limit of .08.
It was almost 3:30 a.m.
An hour later, the woman was on her way into the bowels of the Anderson County Detention Center after being processed on a charge of minor-in-possession of alcohol for the purpose of consumption.
Because the woman was 20, Frazier said, state law applies in one of two ways: Either the woman can be charged with possession of alcohol or with DUI.
The possession charge and positive BAC test combine in an administrative capacity, meaning the woman will lose her license for at least 90 days but will not face the legal liabilities of a DUI charge.

“Charging someone under 21 with DUI can go one way or the other,” he said. “Again, it is confusing. I doubt she realizes what a bullet she’s dodged.”

That’s just one DUI and I haven’t even done the paperwork on it. Distracted driving is one of the biggest danger. We have banned the cellphones and text messaging. Soon it would be time when we will have to ban the use of i-pods since i-pods are being used for social media and other purposes and this could be dangers.

The National Highway Traffic Safety Administration reports that nearly 6,000 people died in 2008 in crashes involving a distracted or inattentive driver, and more than half a million were injured. Many of them were teens.

According to the Insurance Institute for Highway Safety, seven states currently ban driving while talking on a hand-held cell phone. The use of all cell phones by novice drivers is restricted in 21 states and the District of Columbia.

Text messaging is banned for all drivers in 19 states and the District of Columbia. In addition, novice drivers are banned from texting in nine states.Florida, Kentucky and Alabama are among the states weighing their own bans.Nearly one out of five U.S. drivers surveyed has read or sent a text message while behind the wheel, according to a recent AAA survey – even though they consider such action unacceptable.

The AAA, the National Safety Council and most safety advocates have urged texting bans for drivers in all 50 states. The insurance industry conducted a study to find out whether this law should really be passed.

The Highway Loss Data Institute study found that claims rates did not go down after the laws were enacted. It also found no change in patterns compared with nearby states without such bans.

HLDI is a respected research group but its results in this study seem to defy everyday experience, common sense and human psychology. It found that this required multi-tasking and these are complex things which requires concentration. The psychologist have stated that both driving and talking on the phone require brain demands and hence it is very likely that the driving is impacted whilst talking. Text mesaaging is even more complex than talking on the phone.

It is best to be safer than to regret things in the future since sometimes regret also never brings back life or a lost one. Distracted driving has lead to accidents and you would certainly end up being a high risk driver. A jurisdiction-wide ban on driving while talking on a hand-held cellphone is in place in 7 states (California, Connecticut, New Jersey, New York, Oregon, Utah, and Washington) and the District of Columbia. Utah has named the offense careless driving. Under the Utah law, no one commits an offense when speaking on a cellphone unless they are also committing some other moving violation other than speeding.

Local jurisdictions may or may not need specific state statutory authority to ban cellphones. Localities that have enacted restrictions on cellphone use include: Oahu, HI; Chicago, IL; Brookline, MA; Detroit, MI; Santa Fe, NM; Brooklyn, North Olmstead, and Walton Hills, OH; Conshohocken, Lebanon, and West Conshohocken, PA; Waupaca County, WI; and Cheyenne, WY.

Localities are prohibited from banning cellphone use in 8 states (Florida, Kentucky, Louisiana, Mississippi, Nevada, Oklahoma, Oregon, and Utah).
The use of all cellphones while driving a school bus is prohibited in 17 states and the District of Columbia.
The use of all cellphones by novice drivers is restricted in 21 states and the District of Columbia.
