When the 20 minutes had elapsed, the girl blew into the BAT testing machine.
Her blood-alcohol-content came back several points above the legal limit of .08.
It was almost 3:30 a.m.
An hour later, the woman was on her way into the bowels of the Anderson County Detention Center after being processed on a charge of minor-in-possession of alcohol for the purpose of consumption.
Because the woman was 20, Frazier said, state law applies in one of two ways: Either the woman can be charged with possession of alcohol or with DUI.
The possession charge and positive BAC test combine in an administrative capacity, meaning the woman will lose her license for at least 90 days but will not face the legal liabilities of a DUI charge.

The National Highway Traffic Safety Administration reports that nearly 6,000 people died in 2008 in crashes involving a distracted or inattentive driver, and more than half a million were injured. Many of them were teens.

According to the Insurance Institute for Highway Safety, seven states currently ban driving while talking on a hand-held cell phone. The use of all cell phones by novice drivers is restricted in 21 states and the District of Columbia.

Text messaging is banned for all drivers in 19 states and the District of Columbia. In addition, novice drivers are banned from texting in nine states.Florida, Kentucky and Alabama are among the states weighing their own bans.Nearly one out of five U.S. drivers surveyed has read or sent a text message while behind the wheel, according to a recent AAA survey – even though they consider such action unacceptable.

The AAA, the National Safety Council and most safety advocates have urged texting bans for drivers in all 50 states. The insurance industry conducted a study to find out whether this law should really be passed.

The Highway Loss Data Institute study found that claims rates did not go down after the laws were enacted. It also found no change in patterns compared with nearby states without such bans.

HLDI is a respected research group but its results in this study seem to defy everyday experience, common sense and human psychology. It found that this required multi-tasking and these are complex things which requires concentration. The psychologist have stated that both driving and talking on the phone require brain demands and hence it is very likely that the driving is impacted whilst talking. Text mesaaging is even more complex than talking on the phone.

It is best to be safer than to regret things in the future since sometimes regret also never brings back life or a lost one. ” This type of unforeseen event is what insurance is for,” said PCI’s Passmore. “If the pedal is a factor, the insurer will pay the claim for the driver and then likely seek to be reimbursed by Toyota. This is one less thing for the consumer to worry about

In the event that a driver experiences an accelerator pedal that sticks or returns slowly to idle position, Toyota says the vehicle can be controlled with firm and steady application of the brakes. The brakes should not be pumped repeatedly because it could deplete vacuum assist, requiring stronger brake pedal pressure. The vehicle should be driven to the nearest safe location, the engine shut off and a Toyota dealer contacted for assistance.

Insurers want consumers to know that if Toyota’s recalled part causes an accident, the driver’s automobile liability or physical damage insurance will provide coverage.

There is also good news for consumers because a vehicle recall by itself will generally not cause insurance rates to increase, Passmore said. “Looking forward, it is unlikely that rates would be affected by the recall.”

Over the years Toyotas have had a good safety record as evidenced by their popularity, so it is unlikely that there will be enough accidents caused by the faulty pedals that rates will increase, according to Passmore.

“Insurers look at the cost of claims over a period of time for vehicle,” he added. “They are interested in how much it costs to repair a vehicle and how often the vehicle is involved in an accident.”

While Toyota is pursuing repairs to recalled vehicles, the nation’s largest auto insurer says Toyota vehicle safety has been a concern for some time.

A jurisdiction-wide ban on driving while talking on a hand-held cellphone is in place in 7 states (California, Connecticut, New Jersey, New York, Oregon, Utah, and Washington) and the District of Columbia. Utah has named the offense careless driving. Under the Utah law, no one commits an offense when speaking on a cellphone unless they are also committing some other moving violation other than speeding.

Local jurisdictions may or may not need specific state statutory authority to ban cellphones. Response : Martin, a lot of questions but relevant ones. Alcohol impaired driving or DUI driving under influence or driving under intoxication is when one has BAC levels of 0.08 and beyond. This figure has not been arrived just from the thin air but based on research, statistics and scientific data all combined. Even if you consider the recent statistics gathered by the NHTSA National Center for Statistic and Analysis than the data for the past ten years bespeaks of the fact that BAC levels of 0.08 or higher have been found in cases of  motor vehicle accidents and fatal losses.

What is more disturbing is the fact that the incident of alcohol impaired driving  at these BAC levels have lead to fatal accidents in children. Below are some statistical data from the NHTSA.

In 2008, a total of 1,347 children age 14 and younger were killed in motor vehicle traffic crashes. Of those 1,347 fatalities, 216 (16%) occurred in alcohol-impaired-driving crashes. Out of those 216 deaths, 99 (46%) were occupants of a vehicle with a driver who had a BAC level of .08 or higher. Another 34 children age 14 and younger who were killed in traffic crashes in 2008 were pedestrians or pedal cyclists who were struck by drivers with a BAC of .08 or higher.

The national rate of alcohol-impaired-driving fatalities in motor vehicle crashes in 2008 was 0.40 per 100 million vehicle miles of travel.
